Terms of service
General Terms and Conditions (GTC), Withdrawal Information and Voluntary 30-Day Return Policy
of BLOXS GmbH for the famolino online shop
As of: 1 July 2026
1. Scope and Contracting Party
-
These General Terms and Conditions apply to all orders placed through the online shop at www.famolino.com.
-
The customer’s contracting party is:
BLOXS GmbH
Tölzer Straße 37
82031 Grünwald
Germany
Phone: 089 244 182 183
Email: kontaktⓐfamolino.com
Commercial Register: Munich Local Court, HRB 257573
VAT Identification Number: DE332910108 -
BLOXS GmbH operates the online shop under the “famolino” brand. Shopify provides the technical platform for the online shop but is not a party to the sales contracts between BLOXS GmbH and the customer.
-
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person, or a partnership with legal capacity, who, when entering into a contract, acts in the course of their trade, business or profession.
-
These GTC apply to consumers and entrepreneurs. Provisions that apply specifically to consumers or entrepreneurs are identified as such.
-
The GTC are made available to the customer before the contract is concluded. The customer may access, save and print the GTC through the online shop. The contractual documents, including the order details and the legal terms applicable to the contract, are also made available to the customer by email or by another means that allows them to be reproduced unchanged at a later date.
2. Formation of Contract and Orders
-
The products displayed in the online shop do not constitute a legally binding offer. They are an invitation for the customer to submit an offer.
-
By submitting an order, the customer makes a binding offer to enter into a sales contract for the products in the shopping cart. The customer should carefully review the order before submitting it, as requests to change or cancel it may no longer be accommodated after the order has been accepted.
-
The customer will be notified of receipt of the order by email without undue delay. This acknowledgement confirms receipt only and does not constitute acceptance of the offer, unless it is expressly described as an order confirmation or expressly states that the order has been accepted.
-
The contract is concluded when BLOXS GmbH expressly accepts the order, in particular by sending a separate order confirmation by email, or fulfils the order by conduct indicating acceptance. Dispatch of the ordered goods to the customer constitutes acceptance of the offer.
-
BLOXS GmbH must have received and processed the payment before accepting the order. Successful payment authorisation or a charge alone therefore does not constitute acceptance of the offer, unless BLOXS GmbH also expressly confirms the order or fulfils it by dispatching the goods.
-
Merely processing the order internally or preparing for production does not, by itself, constitute acceptance, unless BLOXS GmbH expressly informs the customer otherwise. Once production has begun, the order can generally no longer be changed or cancelled. The customer’s statutory rights, in particular any existing right of withdrawal and statutory rights relating to defective goods, remain unaffected.
-
BLOXS GmbH reserves the right to reject, amend or cancel orders for a legitimate reason, in particular if a product is unavailable, there is a technical error or an obvious error in the price or product description, there is reasonable suspicion of a violation of rights, or other circumstances make proper fulfilment of the order unreasonable or impossible. BLOXS GmbH will notify the customer using the contact details provided with the order. Any payments already made will be refunded without undue delay if the order is rejected or cancelled.
-
BLOXS GmbH may change the products offered, product descriptions, prices, promotions and available quantities at any time for future orders. The price displayed in the online shop when the customer submits their order applies to that customer, unless there is an obvious pricing or transmission error. The customer’s mandatory statutory rights remain unaffected.
-
Before submitting the order, the customer can review their details and selected products and correct input errors using the correction options provided in the shop.
-
The contract language is German. The contractual documents, including the order details and the legal terms applicable to the contract, are made available to the customer by email or by another means that allows them to be reproduced unchanged at a later date.
-
The customer confirms that the order, payment, billing and shipping details they provide are complete, accurate and up to date, and that they are authorised to use the payment method specified.
-
The products offered in the shop are generally intended for personal or household use. Orders for commercial resale or export may be rejected. Regular orders placed by entrepreneurs are subject to statutory provisions and these GTC, unless otherwise agreed in an individual case.
3. Products and Personalisation
-
famolino offers, in particular, personalised NFC cards, multiple cards sold as sets or bundles, accessories and gift packaging.
-
The basic layout of the cards is specified for each product. This may include, in particular, the position of text, images, icons, colours and other design elements.
-
Depending on the card layout and functionality, different details may be possible or required within the relevant basic layout, for example names, labels, subtitles, photos, telephone numbers, URLs, FaceTime accounts, telephone numbers for WhatsApp or SMS, and other contact or linking details.
-
Depending on the card ordered, the NFC function may, for example:
a. initiate a phone call using a telephone number;
b. start a FaceTime video or audio call;
c. open a URL;
d. open a WhatsApp chat; or
e. open an SMS chat. -
The specific function is set out in the relevant product description. famolino does not provide its own digital landing pages, customer profiles or other digital profiles. The card may open an external address or function provided by the customer.
-
Using the NFC function may require an NFC-enabled and compatible smartphone, suitable software, certain device settings, an internet or mobile connection and, where applicable, a third-party app. The functionality of external websites, apps, telephone numbers, messaging accounts, FaceTime accounts and other services also depends on the relevant third-party providers.
-
Images and product displays may differ from the delivered goods in terms of colour, brightness and appearance where this is due to screens, printing processes, materials or other technical circumstances and does not affect the agreed characteristics of the goods.
-
The safety and usage instructions applicable to each product will be made clearly and visibly available to the customer on the relevant product page before the contract is concluded, in the version applicable at the time the contract is concluded, and will be included with the product. They must be followed before first use. Product-specific instructions supplement the product description; the customer’s mandatory statutory rights remain unaffected.
-
The product-specific safety and usage instructions also apply to accessories supplied with the product or ordered separately, in particular lanyards, key rings, card holders, card stands and wrist straps. These instructions will be made available to the customer on the relevant product page before the contract is concluded and included with the product. They must be followed before first use.
4. Customer Information and Production Process
-
The customer is responsible for the accuracy and completeness of all data they enter or upload.
-
This applies in particular to names, text, subtitles, telephone numbers, URLs, FaceTime accounts, WhatsApp numbers, SMS numbers, photos and other content.
-
The online configurator generates a print-ready file from the customer’s input. The design created by the customer in the configurator and submitted with the order is the design used for production.
-
As a rule, BLOXS GmbH does not carry out a separate print check, proofreading or approval process. The design created by the customer in the online configurator and submitted with the order is the design that will be printed.
-
Where provided for in the relevant product, the image file submitted for printing will be used identically on the front and back.
-
The customer must carefully review the design and all information entered before submitting the order. BLOXS GmbH is not required to correct customer input or point out spelling errors, transposed digits, incorrect telephone numbers, faulty URLs or other input errors.
-
Errors resulting solely from customer input do not constitute a defect for which BLOXS GmbH is responsible, provided the goods have been produced in accordance with the order submitted.
-
Changes after the contract has been concluded are possible only if production has not yet begun and the change can be implemented technically and operationally. There is no entitlement to changes once production has begun. If the customer is responsible for the change, a reasonable additional charge may apply.
-
BLOXS GmbH may reject content or postpone production where there are specific grounds to believe that the content is unlawful, insulting, discriminatory, pornographic, glorifies violence or is likely to infringe third-party rights.
-
The relevant offer contains the information material to the purchase decision, in particular the essential characteristics of the goods, the price including VAT, shipping costs, payment methods, delivery or production time and—where applicable—a clear notice that the statutory right of withdrawal is excluded for personalised goods.
5. Customer Content and Third-Party Rights
-
The customer confirms that they are authorised to use and provide all content and data they submit.
-
This applies in particular to photos, logos, graphics, names, text, telephone numbers, URLs and other personal or identifying information.
-
If photos show other people, the customer must have obtained the consent or other legal permissions required to use the photos and provide them to BLOXS GmbH.
-
The customer is responsible for ensuring that placing the order does not infringe any copyright, trademark, personality, data protection or other third-party rights.
-
The customer grants BLOXS GmbH the non-exclusive rights of use required to review, technically process, produce, store, reproduce and deliver the ordered goods. The grant of rights is limited to these purposes and the period necessary for them.
-
The customer shall indemnify BLOXS GmbH against legitimate third-party claims arising from an infringement of third-party rights through content or data provided by the customer, where the customer is responsible for that infringement. The indemnity also covers reasonable costs of necessary legal defence. This indemnity does not apply to the extent that BLOXS GmbH is responsible for the infringement or the customer is not responsible for it.
6. Prices, VAT and Shipping Costs
-
The prices displayed in the online shop at the time the order is placed apply. Unless expressly stated otherwise, all prices for consumers are final prices inclusive of applicable statutory VAT.
-
Shipping costs are displayed in the online shop and, at the latest, at checkout before the order is submitted.
-
Shipping within Germany is free for orders with a goods value of EUR 50.00 or more. For orders below this value, the shipping costs shown in the online shop or at checkout apply.
-
For deliveries to other Member States of the European Union, the shipping costs shown at checkout for the relevant destination country apply. Deliveries are made only to countries that can be selected as a destination country in the online shop.
-
The payment methods currently available are displayed at checkout. These may include, in particular, PayPal, Shop Pay, Visa, Mastercard, Apple Pay, Google Pay and Klarna. The availability of individual payment methods may vary depending on the destination country, shopping cart, technical availability and the outcome of a payment or credit check.
-
Klarna’s additional payment and credit terms may apply when using Klarna. Klarna may provide the customer with further information about these separately.
-
Unless otherwise stated at checkout, payment is due immediately after the contract is concluded.
7. Delivery and Delivery Time
-
BLOXS GmbH delivers to Germany and to Member States of the European Union, provided the relevant country can be selected in the online shop.
-
Production generally takes 3 to 5 working days until the goods are ready for dispatch. The delivery time of the relevant shipping service provider must be added to this. The production and delivery time applicable to each product is stated on the product page or at checkout.
-
For advance payment, the delivery period begins on the day after payment is received; for other payment methods, it begins on the day after the contract is concluded, unless otherwise stated at checkout or in the order confirmation.
-
If delivery is delayed, BLOXS GmbH will inform the customer as soon as it becomes aware of the delay. The customer’s statutory rights remain unaffected.
-
Partial deliveries are permitted provided they are reasonable for the customer. No additional shipping costs will be charged to the customer as a result.
-
For consumers, the risk of accidental loss or accidental deterioration generally passes only when the goods are handed over to the consumer or to a person authorised by the consumer to receive them. For entrepreneurs, the statutory rules on the passing of risk apply.
-
The customer is responsible for ensuring that the delivery address is correct. Costs arising from an incorrect or incomplete delivery address for which the customer is responsible may be charged only to the extent permitted by law.
8. Retention of Title
The goods remain the property of BLOXS GmbH until payment has been made in full. For entrepreneurs, the retention of title also applies to claims arising from ongoing business relationships, to the extent permitted by law.
9. Statutory Rights Relating to Defective Goods
-
Statutory rights relating to defective goods apply.
-
The customer may report defects by email to kontaktⓐfamolino.com, preferably including the order number, a description of the issue and, where useful, photos. This contact is intended to facilitate prompt handling and is not an additional condition for exercising statutory rights.
-
An input, design or data error caused by the customer is not a defect if BLOXS GmbH produced the goods in accordance with the order.
-
A failure of NFC recognition is not automatically a defect if it is due to an incompatible or unsupported smartphone, operating system, missing app, device setting, lack of an internet or mobile connection, or a fault with a third-party provider. A defect may exist if the card does not function as agreed despite suitable use and compatible conditions, and the cause is within BLOXS GmbH’s area of responsibility.
-
If the goods are defective, the customer has the statutory rights, including the right to subsequent performance, a price reduction, withdrawal from the contract and, where applicable, damages.
10. Complaints and Customer Service
-
The customer may send complaints and questions about orders, delivery, personalisation or product functionality by email to kontaktⓐfamolino.com. Where possible, complaints should include an order number, a description of the issue and photos, if useful.
-
BLOXS GmbH will generally acknowledge receipt of a complaint within 14 days. If it is not possible to resolve the matter fully within that period, the customer will receive an interim update within the same period explaining how the matter will be handled next. The customer’s statutory rights relating to defective goods and other rights remain unaffected.
11. Statutory Right of Withdrawal
-
Consumers generally have a statutory right of withdrawal for distance contracts in accordance with the statutory provisions.
-
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for which an individual choice or decision by the consumer is material to their production, or which are clearly tailored to the consumer’s personal needs.
-
For famolino, this statutory exclusion may apply in particular to an NFC card made using individual names, labels, subtitles, photos, telephone numbers, URLs, or WhatsApp, SMS or FaceTime details provided by the customer. Whether the exclusion applies must be assessed for the specific product variant and order.
-
The statutory right of withdrawal is not excluded by a blanket acceptance of these GTC. The only relevant question is whether the statutory requirements for exclusion are met in the specific case.
-
The statutory right of withdrawal generally applies to non-personalised accessories and non-personalised gift packaging, unless another statutory exclusion applies.
-
For mixed sets or bundles, it must be assessed separately for each item whether a right of withdrawal applies.
-
The following withdrawal information applies only where a statutory right of withdrawal exists for the relevant goods.
Withdrawal Information
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
You are not required to state a reason for withdrawing. If you choose to tell us your reason, this will help us identify any potential issues and, where appropriate, take corrective action.
The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and designated by you, receive the goods. If you have ordered several goods as part of a single order and they are delivered separately, the period begins on the day you receive the last item.
To exercise your right of withdrawal, you must inform us:
BLOXS GmbH
Tölzer Straße 37
82031 Grünwald
Germany
Email: kontaktⓐfamolino.com
Phone: 089 244 182 183
of your decision to withdraw from this contract by means of an unequivocal statement, for example, a letter sent by post or an email. You may use the model withdrawal form below, but this is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs, without undue delay and no later than fourteen days from the day on which we received notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless we have expressly agreed otherwise with you.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will bear the direct cost of returning the goods.
You are liable for any diminished value of the goods only if that loss in value results from handling the goods in a way that was not necessary to establish their nature, characteristics and functioning.
Exclusion of the Right of Withdrawal for Personalised Cards
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and are made on the basis of an individual choice or decision by the consumer, or are clearly tailored to the consumer’s personal needs.
For famolino, this exclusion may apply in particular to an NFC card made using individual names, labels, subtitles, photos, telephone numbers, URLs, or WhatsApp, SMS or FaceTime details provided by the customer. Whether the exclusion applies must be assessed for the specific product variant and order.
A statutory exclusion of the right of withdrawal does not affect statutory rights relating to defective goods.

11. Voluntary 30-Day Return Policy
-
In addition to statutory rights, famolino grants consumers a voluntary 30-day right to return goods, starting from the date the goods are received. This voluntary return policy applies to cards and accessories subject to the following provisions.
-
The customer must register the return by email to kontaktⓐfamolino.com within 30 days of receiving the goods. The email should include the order number and the items concerned. No reason for the return needs to be given. However, voluntarily providing a reason may help us identify any potential issues and, where appropriate, take corrective action.
-
Once the return request has been received, famolino will check whether the requirements of this voluntary return policy have been met and will notify the customer of the return authorisation and return address. A return may be refused only for a legitimate reason, in particular if a deadline has been missed, the policy is being used abusively, there is a specific suspicion of fraud, or the goods are not from the relevant order.
-
Once return authorisation has been granted, the customer must send the goods to the return address provided within seven days. The deadline is met if the goods are dispatched within that period.
-
The customer bears the direct cost of return shipping. famolino does not provide a return label for returns made under this voluntary policy.
-
The goods should be returned complete, clean and with all accessories. To use the voluntary 30-day return policy, personalised famolino cards must be returned in their complete original gift packaging. This requirement applies exclusively to the voluntary return policy. It does not restrict the customer’s statutory rights, in particular any existing right of withdrawal or statutory rights relating to defective goods. Under the voluntary return policy, famolino may make a reasonable and transparently calculated deduction for a specific reduction in value resulting from use beyond what is necessary to examine the nature, characteristics and functioning of the goods.
-
For an authorised voluntary return, famolino will generally refund the value of the goods. The original delivery costs will not be refunded under this voluntary return policy. Mandatory statutory reimbursement rights, in particular those arising from statutory withdrawal or a defect, remain unaffected.
-
Unless otherwise agreed, the refund will be made using the payment method used for the order, no later than 30 days after the returned goods have been received and inspected.
-
Voluntary returns do not restrict statutory rights of withdrawal or statutory rights relating to defective goods. In particular, statutory rights must not be made conditional on return authorisation, original packaging or a particular return procedure.
12. Liability
-
BLOXS GmbH has unlimited liability for damage resulting from injury to life, body or health; for damage caused intentionally or through gross negligence; and under mandatory provisions of the German Product Liability Act.
-
In the event of a slightly negligent breach of material contractual obligations, BLOXS GmbH is liable only for damage that is typical of the contract and foreseeable. Material contractual obligations are obligations whose fulfilment is essential to the proper performance of the contract and on whose fulfilment the customer may generally rely.
-
In all other cases, liability for damage caused by slight negligence is excluded to the extent permitted by law.
-
BLOXS GmbH is not liable for the availability, functionality, accessibility, modification or blocking of external websites, telephone numbers, FaceTime accounts, WhatsApp accounts, SMS services, apps, operating systems or other third-party services, unless BLOXS GmbH is responsible for this.
-
BLOXS GmbH is not liable for damage caused by incorrect information or use by the customer, misuse, an unsupported device, a missing connection or an unsupported third-party app, unless mandatory statutory liability applies.
-
The foregoing limitations of liability also apply for the benefit of BLOXS GmbH’s legal representatives, employees and vicarious agents.
13. Intellectual Property and Shop Content
All text, images, designs, logos, product displays, trademarks and other content in the online shop are protected by copyright, trademark law or other intellectual property rights. Use beyond what is necessary to visit and shop in the online shop requires prior consent, unless statutory exceptions apply.
14. Third-Party Providers and External Services
-
Use of the NFC function may depend on third-party services, in particular operating systems, smartphones, mobile and internet access, apps, websites, telephony, FaceTime, WhatsApp or SMS services.
-
The availability and functionality of such services may be outside BLOXS GmbH’s control. If the customer provides external services or destination addresses, the terms and privacy notices of the relevant third-party providers may also apply to their use.
-
BLOXS GmbH may develop or replace technical procedures, production processes and service providers, provided this does not materially affect the main service owed under the contract.
15. Data Protection
Personal data is processed in accordance with the Privacy Policy, which is available in the online shop.
15. Consumer Dispute Resolution
BLOXS GmbH is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless required to do so by law in a particular case.
The former EU Online Dispute Resolution platform is not linked to. The statutory information requirements concerning consumer dispute resolution in force from time to time shall apply.
16. Choice of Law and Jurisdiction
-
German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
-
For consumers, the statutory rules on jurisdiction apply.
-
For entrepreneurs, legal entities under public law and special funds under public law, Leipzig is agreed as the place of jurisdiction, to the extent permitted by law.
17. Amendments to These GTC
BLOXS GmbH may amend these GTC with effect for the future where there is a legitimate reason, in particular a change in the law, case law, technical requirements, security requirements or operational procedures. Consumers will be notified of amendments in good time. Where express consent is required by law, it will be obtained. For entrepreneurs, amendments apply only if they have been agreed or validly incorporated with due consideration for their interests.
18. Final Provisions
If any provision of these GTC is or becomes invalid, the remaining provisions remain valid. The statutory provisions shall replace the invalid provision. No provision shall be reduced to the extent necessary to preserve its validity.
